Injunctions

Successfully challenged a request securing the dismissal of a motion for a provisional interlocutory injunction against an ex-employee, and the company for which he works, in IMS Health  Canada inc. v.Th!nk Business Insights Ltd. v. Mark Maciw, 2013 QCCS 16.

Successfully challenged implementing rules of an Anton Piller injunction order and seizure of pirated material; IMS Health Canada inc. v. Th!nk Business Insights Ltd. and Mark Maciw, 2013 QCCA 688.

Representation of various clients seeking orders forcing former employees to meet their obligations of loyalty and non-competition.

Professional Liability

Representation of Chrysler Canada Inc. and CIBC Mellon Trust Company in the context of a $165 million lawsuit against the Castor Holdings auditors.

Obtained several judgments dismissing professional liability suits against accountants and trustees in bankruptcy, in:

Gestion Michel Noël ltée v. Dallaire, Forest, Kirouac, 2011 QCCS 1293 and 2011 QCCS 809;

Finexcorp inc. v. Caroline Tremblay, CA  inc., 2010 QCCA 595;

X Merchant inc. v. Ginsberg, Gingras & Associés inc., 2009 QCCS 2042.

Representation of investors against a major financial institution for misconduct in the management of their assets.

Class Actions

Participated in securing a class action judgment against a semi-public agency acting as a pension manager to pay considerable damages to several  pensioners following the dissemination of      misleading information, in Myette v. Commission  administrative des régimes de retraite et d’assurances, 2010 QCCS 2797.

Representation of a major company engaged in mutual funds in the context of a class action involving "Market Timing" transactions.

Representation of a major homeopathic product  manufacturer in defense of a class action.
